Top 10 WSIB Red Flags That Can Get Your Claim Denied

WSIB decision-makers are trained to identify patterns that suggest a claim may not be legitimate or may have complicating factors. These "red flags" do not automatically result in denial, but they trigger closer scrutiny and can significantly impact how your claim is adjudicated.

Understanding these red flags is valuable whether you are a worker filing a claim, a lawyer assessing claim viability, or an HR professional reviewing an incident. Here are the 10 most common red flags and how to address them proactively.

1. Delayed Reporting

Under OPM 15-01-02, employers must file Form 7 within 3 business days of learning about the injury, and workers should report injuries to their employer as soon as possible. While late reporting does not automatically bar a claim, it is one of the strongest credibility indicators decision-makers consider.

A delay of more than 72 hours between the injury and the initial report raises questions. A delay of weeks or months raises serious concerns. If there is a legitimate reason for the delay (such as not realizing the severity initially, or being hospitalized), document it clearly.

2. No Witnesses to the Incident

Claims where the worker was alone when the injury occurred receive additional scrutiny. This does not mean they will be denied — many legitimate workplace injuries happen when workers are alone. However, the lack of corroboration means the decision-maker relies more heavily on medical evidence and circumstantial factors.

To strengthen a claim without witnesses, ensure the medical evidence is thorough and consistent with the described mechanism. Workplace evidence (such as the uneven floor patch in a forklift incident, or surveillance footage) can substitute for eyewitness testimony.

3. Inconsistent Mechanism of Injury

When the described mechanism does not match the medical findings, decision-makers take notice. For example, if a worker reports a minor bump but presents with a severe disc herniation, the clinical picture needs to be explained — perhaps by a pre-existing condition that was aggravated (covered under OPM 15-04-01).

Consistency between the worker's account, the employer's report, any witness statements, and the medical findings is crucial. If there are discrepancies, they should be addressed head-on rather than ignored.

4. Prior Claims on the Same Body Part

A history of previous WSIB claims involving the same body part raises questions about whether the current condition is truly a new work-related injury or a continuation of a prior condition. This is where the distinction between a recurrence (OPM 11-01-06) and a new injury matters significantly.

If it is a recurrence, the worker does not need a new accident — they need to show the current symptoms relate to the original work injury. If it is a new injury, they need to satisfy all five points of the Five Point Check independently.

5. Delayed Medical Treatment

Seeking medical attention days or weeks after the reported date of injury undermines the credibility of the claim. Decision-makers expect that a genuine injury severe enough to warrant WSIB benefits would prompt reasonably prompt medical attention.

There are legitimate reasons for delayed treatment: some conditions worsen gradually, emergency departments have long waits, or the worker may have initially believed the injury was minor. Document the reason for any delay.

6. Filing Coincides with Workplace Conflict

Claims filed shortly after a disciplinary action, performance review, termination notice, or workplace dispute receive heightened scrutiny. While the timing alone cannot be used to deny a claim (a worker can be injured at any time, including during workplace conflict), it is a pattern decision-makers are trained to notice.

The key question is whether the medical evidence independently supports the claimed injury, regardless of the workplace dynamics.

7. Symptom Magnification or Non-Organic Signs

When clinical findings suggest the worker may be overstating their symptoms — such as Waddell signs in back injury cases, or inconsistencies between observed function and reported limitations — decision-makers may question the degree of disability.

This does not mean the worker is faking the injury. Symptom magnification can occur for many reasons, including fear, anxiety, and genuine pain. However, it can lead to additional medical assessments or independent examinations.

8. Non-Cooperation with Return to Work

Under OPM 19-02-08, workers have an obligation to cooperate in the return-to-work process. This includes maintaining contact with the employer, participating in RTW planning, and accepting suitable modified work when offered. Non-cooperation can result in benefit suspension.

If you are unable to accept modified work, the reason must be supported by medical evidence (such as functional restrictions documented on a FAF that the modified duties do not accommodate).

9. Incomplete or Missing Documentation

Claims missing key documents — especially Form 6 (Worker's Report), Form 7 (Employer's Report), or Form 8 (Health Professional's Report) — are harder to adjudicate and more likely to be delayed or investigated further.

A complete claim file with all three core forms, plus supporting medical records and imaging reports, gives the decision-maker everything needed to render a decision quickly. Evidence gaps invite questions.

10. Inconsistent Statements Across Documents

When the worker's description of the incident on Form 6 differs from what the employer reported on Form 7, or what the physician documented on Form 8, the inconsistencies need to be resolved. Even minor differences in timing, location, or mechanism can become issues during adjudication.

Review all documents before submission to ensure consistency. If there are legitimate differences in perspective, acknowledge and explain them rather than leaving the decision-maker to discover them.

How to Address Red Flags Proactively

The presence of a red flag does not mean a claim is illegitimate. Many valid claims have one or more of these factors. The key is to identify them early and address them head-on with supporting evidence and documentation.

Under OPM 11-01-03 (Merits and Justice), every WSIB decision must be based on the individual facts of the case. And under OPM 11-01-13 (Benefit of Doubt), when evidence is equally balanced, the decision must favour the claimant. Red flags shift the balance, but they do not determine the outcome on their own.
